The Law Office of Richard R. Shaw II is a full service law firm that excels in various areas of practice. Our areas of practice are criminal law, negligence, estate practice, wills and trusts, real estate law, matrimonial law, transportation law, commercial law and collections, bankruptcy, appeals, and civil litigation. The convenience of having an attorney available who concentrates in various areas of law will provide you, the client, the best legal representation. However, be assured that we will readily recommend the referral of particular matters to various outside legal specialists if we feel the referral is necessary and in your best interest.
Our primary areas of practice are as follows:
Criminal Law - Our firm handles all types of criminal matters in all courts of this state, including town and village justice courts, superior courts, and federal courts. We also handle the appeal of criminal matters. Our attorneys are available on a 24 hour basis for emergency procedures such as obtaining release on bail.
Personal Injury and Civil Lawsuits - These are matters which arise from either the careless and/or intentional and/or reckless conduct of others causing an injury to a person or property. When the injury involves Professional Negligence, such as those caused by an architect, an accountant, a lawyer, a physician and/or her staff and hospital, through their employment, this is known as Malpractice. Products Liability is the term used for injuries caused by defective products and their defective warnings and instructions . We have represented clients successfully in these areas . When we represent a plaintiff, the fee is based on a contingent basis - we only get paid upon the full and successful completion of your matter, although our clients are usually responsible for out-of-pocket expenses. Where the representation is on the behalf of the defendant, the fee is based upon a prearranged hourly rate. Matters involving breach of contracts, whether involving sales, employment or real estate are also billed on a hourly basis.
Matrimonial and Family Law - A great deal of our firm's work is in the area of matrimonial and family law. This area concerns all the problems involved in a divorce situation, including investigation and preparation of the financial matters that must be determined whenever a family dissolves. Questions of child custody, support, division of property, visitation, and other legal matters concerning the family are handled by our firm. The Equitable Distribution Law of the State of New York requires thorough knowledge and expertise on the part of the lawyer representing a matrimonial client. Our firm has this expertise and a great deal of our time is spent in representing such clients. Not only do we represent clients in divorce actions, but we also represent clients in Family Court proceedings. In addition, we also prepare antenuptial, prenuptial and separation agreements.
Real Estate - Our law firm handles all problems involved in buying and selling real estate, both residential and commercial. Our firm does its own title insurance work and represents various area banks. We also handle larger and more complicated transactions, including the purchase or sale of commercial buildings and retail establishments, which may include the sale of businesses. We are involved in all areas of these transactions, from the initial negotiations to the actual closings and any follow-up matters that may arise after closing.
Estate Work - Our legal staff handles the drafting and executions of wills and trusts, the probate of wills and the administration of estates. We are conversant with the Federal and New York Estate Tax Laws and how they relate to the saving of money and time to the client and/or the estate. We have expertise in the preparation and filing of the tax forms necessary under the Internal Revenue Code and the New York Tax Law. We also represent the individuals who feel they have questions, problems or disputes as to the administration or handling of that estate.
General Practice - As well as the above main categories, our firm handles most questions concerning federal bankruptcy statutes, including the filing of petitions for both individuals, partnerships, and corporations under that law. We handle collection work for both individuals and firms. We also appear in all courts of the State of New York, both state and federal. We also handle various aspects of transportation law, including the handling and transportation of toxic wastes.
